Winnipeg Free Press: ‘They should bury you under the prison’: Kinew blasts Supreme Court rejection of minimum sentence for child pornography

The province doesn’t have the authority to use the notwithstanding clause in a situation such as the Supreme Court striking down mandatory minimum sentences, said Brandon Trask, Associate Law Professor, University of Manitoba. “Criminal law is under the exclusive jurisdiction of the federal government,” Trask said. “Parliament can take a look at the Supreme Court decision and create a new law that addresses the concerns about the decision. Provinces can’t.”
